Owned and Operated by: Dharmlok Ventures Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 12/9, GF, Malviya Nagar, Jaipur, Rajasthan – 302017, India (CIN: U46901RJ2023PTC088247) (hereinafter referred to as "Dharmlok", "Company", "we", "us", or "our").
1. DEFINITIONS
1.1 "Account" means the registered profile created by a User to access the Platform.
1.2 "Application" or "App" means the Dharmlok mobile application available on Android and iOS platforms.
1.3 "Content" means all text, images, audio, video, graphics, e-books, PDFs, articles, product listings, and other material made available on the Platform.
1.4 "Donation" means any voluntary monetary contribution made by a User through the Platform to a Temple, Religious Organisation, or cause facilitated on the Platform.
1.5 "Products" means physical or digital religious and spiritual goods offered for sale on the Platform, including puja samagri, Rudraksha, yantras, gemstones, brass articles, incense, camphor, spiritual gifts, e-books, and customised religious merchandise.
1.6 "Platform" means collectively the website https://dharmlok.com, the development environment https://dev.dharmlok.com, and the Dharmlok mobile application, together with all sub-domains and successor URLs.
1.7 "Service Provider" means an independent third party registered on the Platform to offer Services, including Pandits, priests, astrologers, temple authorities, religious organisations, spiritual gurus, Kathavachaks, motivational speakers, and vendors/sellers.
1.8 "Services" means collectively all services offered through or facilitated by the Platform, including but not limited to temple information, temple darshan, pilgrimage booking, tour packages, online puja, pandit/priest booking, astrology, horoscope, palm reading, spiritual consultation, Vastu consultation, Kathavachak booking, motivational speaker booking, religious event booking, donation facilitation, live darshan, live TV, religious videos, audio library, religious books, e-books, PDF downloads, Bal Vidya, religious articles, knowledge centre content, and the religious marketplace.
1.9 "User", "you", or "your" means any natural or legal person who accesses, browses, registers on, or uses the Platform.
1.10 "Vendor" means a seller or merchant registered on the Platform's marketplace to list and sell Products.
1.11 "Applicable Law" means the Information Technology Act, 2000; the Digital Personal Data Protection Act, 2023; the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020; the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; the Indian Contract Act, 1872; the Copyright Act, 1957; the Trade Marks Act, 1999; applicable GST laws; FEMA and RBI guidelines where applicable; and any other law of India in force from time to time.
2. ACCEPTANCE OF TERMS
2.1 These Terms of Use ("Terms") constitute a legally binding agreement between you and the Company governing your access to and use of the Platform.
2.2 By accessing, browsing, registering on, downloading, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Refund & Cancellation Policy, Shipping & Delivery Policy, Disclaimer, Cookie Policy, Community Guidelines, and any other policy referenced herein (collectively, the "Policies"), each of which is incorporated by reference.
2.3 If you do not agree to these Terms, you must immediately discontinue use of the Platform.
2.4 These Terms constitute an "electronic record" under the Information Technology Act, 2000 and rules thereunder, and do not require any physical or digital signature to be valid and enforceable.
3. ELIGIBILITY
3.1 You represent that you are at least 18 (eighteen) years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
3.2 Persons under 18 years of age may use the Platform only under the supervision and with the consent of a parent or legal guardian, who shall be responsible for all activity conducted through the minor's use of the Platform.
3.3 The Company reserves the right to refuse access to, or terminate the Account of, any person who is found to have misrepresented their age or eligibility.
3.4 Certain Services (e.g., astrology consultations, donations, marketplace purchases) may require the User to be a person competent to contract and to hold a valid payment instrument in their own name or with proper authorisation.
4. USER ACCOUNTS AND REGISTRATION
4.1 Access to certain Services requires creation of an Account using accurate, current, and complete information, including name, mobile number, email address, and other details as prompted.
4.2 You are solely responsible for maintaining the confidentiality of your login credentials, including any OTP, password, or PIN, and for all activities that occur under your Account.
4.3 You must notify the Company immediately at the contact details in Clause 32 upon becoming aware of any unauthorised use of your Account.
4.4 The Company shall not be liable for any loss or damage arising from your failure to comply with this Clause 4.
4.5 One natural person may maintain only one Account, unless otherwise permitted by the Company in writing.
4.6 The Company reserves the right to verify the information provided at registration and to suspend or terminate any Account that is found to be fraudulent, duplicate, or in breach of these Terms.
5. USER OBLIGATIONS
You agree that you shall:
5.1 Provide true, accurate, and complete information at all times;
5.2 Use the Platform only for lawful purposes and in accordance with these Terms;
5.3 Not impersonate any person or entity or misrepresent your affiliation with any person or entity;
5.4 Comply with all Applicable Law while using the Platform, including while making Donations, purchasing Products, or booking Services;
5.5 Independently verify the credentials, qualifications, and suitability of any Service Provider before engaging their Services;
5.6 Bear sole responsibility for decisions made or actions taken in reliance on Content or Services obtained through the Platform, including religious, spiritual, or astrological guidance.
6. PROHIBITED ACTIVITIES
You shall not, and shall not permit any third party to:
6.1 Use the Platform to transmit any content that is defamatory, obscene, pornographic, hateful, communally sensitive, or that promotes enmity between religious, racial, or linguistic groups;
6.2 Upload or transmit any virus, malware, or other code designed to disrupt the Platform or any connected system;
6.3 Attempt to gain unauthorised access to the Platform, other Users' Accounts, or the Company's systems and networks;
6.4 Scrape, crawl, or use any automated means to extract data from the Platform without prior written consent;
6.5 Engage in fraudulent transactions, chargeback abuse, or misuse of the payment gateway;
6.6 Post fake reviews, manipulate ratings, or otherwise interfere with the integrity of Content on the Platform;
6.7 Reverse engineer, decompile, or attempt to derive the source code of the Platform or Application;
6.8 Use the Platform to solicit, advertise, or transact outside the Platform in circumvention of applicable commissions or fees, where such circumvention is prohibited under the relevant Vendor Terms or Service Provider Agreement;
6.9 Violate the intellectual property, privacy, or other rights of the Company or any third party;
6.10 Use the Platform in any manner that could disable, overburden, damage, or impair it.
6.11 Breach of this Clause 6 shall entitle the Company to immediately suspend or terminate the User's Account, in addition to any other remedy available in law.
7. PLATFORM SERVICES
7.1 The Platform is an integrated religious technology ecosystem that enables Users to access temple information, book pilgrimage and tour packages, engage Service Providers for puja, astrology, and spiritual consultation, make Donations, access religious digital content, and purchase religious Products.
7.2 The Company facilitates the connection between Users and independent Service Providers/Vendors. Except where the Company itself directly supplies a Service or Product, the Company acts as a technology intermediary and marketplace facilitator, and is not itself the provider of the underlying religious, spiritual, astrological, or ritual service.
7.3 Availability of Services may vary by location, season, and third-party availability, and the Company does not guarantee uninterrupted or error-free access to any Service at all times.
8. THIRD PARTY SERVICES
8.1 The Platform may enable access to, or feature, Service Providers, Vendors, temples, and religious organisations who are independent third parties and not employees, agents, or representatives of the Company.
8.2 The Company is not responsible for the acts, omissions, conduct, competence, or representations of any Service Provider or Vendor, and does not endorse any particular Service Provider or Vendor over another merely by reason of listing.
8.3 Any dispute arising between a User and a Service Provider or Vendor shall be resolved directly between such parties; the Company may, at its discretion and without obligation, assist in good-faith resolution.
9. RELIGIOUS DISCLAIMER AND SPIRITUAL ADVICE DISCLAIMER
9.1 The Platform provides access to religious, devotional, astrological, and spiritual content and Services as a matter of belief, faith, tradition, and cultural practice.
9.2 Astrology, horoscope, palm reading, Vastu consultation, and spiritual guidance offered through the Platform are provided for informational, cultural, and entertainment purposes and reflect the personal views, tradition, and interpretive judgment of the individual Service Provider.
9.3 The Company makes no representation or warranty as to the accuracy, efficacy, or outcome of any religious ritual, puja, astrological reading, or spiritual consultation, and does not guarantee any particular result, benefit, or outcome from participation in or reliance upon such Services.
9.4 Nothing on the Platform constitutes professional medical, legal, financial, psychological, or investment advice. Users must consult appropriately qualified professionals for such matters and must not treat any Content or Service on the Platform as a substitute for such professional advice.
9.5 Participation in any ritual, puja, donation, or consultation is a matter of personal faith and voluntary choice of the User.
10. NO GUARANTEE CLAUSE
10.1 The Company does not guarantee any specific spiritual, religious, astrological, health, financial, or personal outcome as a result of using the Platform or any Service booked through it.
10.2 Testimonials, reviews, and Content on the Platform reflect individual views and experiences and are not a guarantee of similar results for any other User.
11. MARKETPLACE TERMS
11.1 Products listed on the Platform's marketplace may be sold by the Company directly or by independent Vendors. Where sold by a Vendor, the contract of sale is between the User and the Vendor, and the Company facilitates the transaction as an intermediary.
11.2 Product descriptions, images, and specifications are provided by the Vendor or the Company to the best of available information; minor variations (colour, size, finish) may occur, particularly for handcrafted or natural religious items (e.g., Rudraksha, gemstones).
11.3 All Products are subject to availability. The Company reserves the right to cancel any order where a Product is out of stock or mispriced due to a technical or clerical error, with a full refund of amounts paid.
11.4 Users purchasing gemstones, Rudraksha, or other Products represented to have astrological or spiritual properties acknowledge that such properties are a matter of belief and tradition, and no scientific or medical claim is made.
12. PAYMENT TERMS
12.1 Payments on the Platform may be made through UPI, debit/credit cards, net banking, wallets, or other modes enabled by the Company's payment gateway partners.
12.2 All payment information is processed through PCI-DSS compliant third-party payment gateways; the Company does not store your full card details.
12.3 In the event of a failed transaction where the amount has been debited, the amount shall be refunded/reversed to the original payment source within the timelines prescribed by the relevant payment gateway/bank, ordinarily within 7–10 business days.
12.4 The Company shall not be liable for delays caused by banks, payment gateways, or network service providers.
13. TAXES
13.1 All prices displayed on the Platform are, unless stated otherwise, inclusive of applicable Goods and Services Tax (GST).
13.2 GST invoices shall be issued in accordance with GST law based on the information provided by the User at the time of purchase.
13.3 Users are responsible for providing accurate billing/GSTIN details where applicable for claiming input tax credit.
14. CANCELLATION AND REFUNDS
14.1 Cancellation and refund of bookings, Donations, and Product purchases shall be governed by the Company's separate Refund & Cancellation Policy, available at [insert URL], which is incorporated into these Terms by reference.
15. INTELLECTUAL PROPERTY
15.1 All intellectual property in the Platform, including its name "DHARMLOK", logo, trademarks, design, look and feel, software, and all Company-created Content, is owned by or licensed to the Company and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other Applicable Law.
15.2 No right, title, or interest in the Platform or its Content is transferred to the User except a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes.
15.3 Users shall not reproduce, distribute, modify, publicly display, or create derivative works from any Content without the Company's prior written consent, except as permitted under Applicable Law.
16. USER GENERATED CONTENT
16.1 Users may submit reviews, ratings, comments, photographs, or other content ("User Content") on the Platform.
16.2 By submitting User Content, you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, and display such User Content in connection with the Platform's operation and promotion.
16.3 You represent that you own or have the necessary rights to submit the User Content and that it does not infringe any third-party right or violate Applicable Law.
16.4 The Company reserves the right, but has no obligation, to monitor, edit, or remove any User Content that violates these Terms or is otherwise objectionable, in accordance with the IT Rules, 2021.
17. REVIEWS
17.1 Reviews must reflect the genuine experience of the reviewing User. Fake, incentivised (without disclosure), or manipulated reviews are prohibited and may result in removal of the review and/or suspension of the Account.
18. CONTENT OWNERSHIP AND LICENCE
18.1 Save for User Content, all Content available on the Platform, including religious articles, e-books, audio, and video, is owned by the Company or licensed from third parties.
18.2 Downloadable Content (e.g., e-books, PDFs) is licensed for personal, non-commercial use only and may not be resold, redistributed, or publicly shared without written permission.
19. SUSPENSION
19.1 The Company may suspend a User's Account, with or without prior notice, where it reasonably believes that the User has violated these Terms, engaged in fraudulent activity, or where required by Applicable Law or a competent authority.
20. TERMINATION
20.1 The Company may terminate or restrict a User's access to the Platform at its discretion, including for breach of these Terms, at any time, with or without notice.
20.2 A User may terminate their Account at any time by submitting a request through the Platform or by writing to the contact details in Clause 32.
20.3 Termination shall not affect any rights or obligations accrued prior to the date of termination, including payment obligations.
21. INDEMNITY
21.1 You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of Applicable Law; (c) your use or misuse of the Platform; or (d) your interaction with any Service Provider or Vendor.
22. LIMITATION OF LIABILITY
22.1 The Platform and all Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Applicable Law, the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
22.2 The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from use of the Platform.
22.3 The Company's aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount actually paid by the User for the specific Service or Product giving rise to the claim, in the preceding three (3) months.
22.4 Nothing in this Clause shall exclude or limit liability that cannot be excluded or limited under Applicable Law.
23. FORCE MAJEURE
23.1 The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural calamities, pandemics, government restrictions, strikes, internet or telecommunication failures, or third-party service outages.
24. GOVERNING LAW
24.1 These Terms shall be governed by and construed in accordance with the laws of India.
25. DISPUTE RESOLUTION AND ARBITRATION
25.1 In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter through good-faith negotiation for a period of thirty (30) days.
25.2 Failing amicable resolution, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by the Company. The seat and venue of arbitration shall be Jaipur, Rajasthan, India, and the language of arbitration shall be English.
25.3 This Clause shall not preclude either party from seeking urgent interim relief from a court of competent jurisdiction.
25.4 Nothing herein shall restrict a consumer's right to approach the appropriate consumer forum/commission under the Consumer Protection Act, 2019.
26. JURISDICTION
26.1 Subject to Clause 25, the courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction over any matter not covered by arbitration or interim relief.
27. SEVERABILITY
27.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
28. WAIVER
28.1 No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver thereof.
29. ASSIGNMENT
29.1 The Company may assign or transfer its rights and obligations under these Terms without the User's consent, including in connection with a merger, acquisition, or sale of assets. Users may not assign their rights under these Terms without the Company's prior written consent.
30. ENTIRE AGREEMENT
30.1 These Terms, together with the Policies incorporated by reference, constitute the entire agreement between the User and the Company regarding use of the Platform.
31. AMENDMENTS
31.1 The Company reserves the right to modify these Terms at any time. Material changes will be notified through the Platform or via email/SMS. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
